Businessman Dominic Hadeed and his wife, Genevieve, are to be released immediately from prison but will remain under strict house arrest, electronic monitoring and sweeping communication restrictions while they continue their legal challenge to the Preventive Detention Orders (PDOs) issued against them during the State of Emergency.
In judgment delivered on Thursday afternoon, the Court of Appeal ruled that the couple should no longer remain in prison pending the determination of their judicial review claim, finding that the State had not provided sufficient particulars to justify their continued detention.
Justices of Appeal Peter Rajkumar, Mira Dean-Armorer and Joan Charles overturned an earlier decision by High Court judge Justice Frank Seepersad, who had refused to grant interim relief.
