BUSINESSMAN Dominic Hadeed and his wife, Genevieve, have taken their fight to the Court of Appeal, challenging a High Court ruling that refused to order their release from detention under the State of Emergency (SoE) regulations.
The notice of appeal, filed on Tuesday, seeks to overturn Justice Frank Seepersad's June 30 decision dismissing their application for interim relief and refusing to order their release pending the hearing of their judicial review challenge. The judge had also ordered the couple to pay the Commissioner of Police's costs in relation to their habeas corpus application.
In their appeal, the Hadeeds are asking the Court of Appeal to set aside that ruling, reconsider their application for interim relief and order their immediate release. Alternatively, they are seeking release on conditions or detention at their Westmoorings home under police supervision until their substantive constitutional challenge is heard. They are also asking that the appeal be treated as urgent and determined before July 27 when their claim for judicial review is to come up for hearing.
