The lawÂsuit against the Catholic Church, St DoÂminic’s ChilÂdren’s Home, and the State will face its first hurÂdle toÂday as the matÂter goes beÂfore JusÂtice CarÂol GobÂin to deÂterÂmine whether the matÂter is too old to purÂsue.
The lawÂsuit was filed on OcÂtoÂber 8. In it, five men are suÂing St DoÂminic’s ChilÂdren’s Home (alÂso reÂferred to as the BelÂmont OrÂphanÂage), the RoÂman Catholic ArchÂdioÂcese in Port-of-Spain, the AtÂtorÂney GenÂerÂal, the StatuÂtoÂry AuÂthorÂiÂties SerÂvice ComÂmisÂsion, and a forÂmer emÂployÂee at the chilÂdren’s home who was latÂer charged with bugÂgery, atÂtemptÂed bugÂgery, and seÂriÂous inÂdeÂcenÂcy.
The filÂing of the lawÂsuit comes afÂter the men isÂsued pre-acÂtion proÂtoÂcol letÂters in 2022, seekÂing at the time some $2.5 milÂlion for six alÂleged vicÂtims. In reÂsponse to the pre-acÂtion proÂtoÂcol letÂter, atÂtorÂney GreÂgoÂry Delzin, now a seÂnior counÂsel, said the lawÂsuit was filed outÂside the leÂgal limÂit as alÂlowed unÂder the LimÂiÂtaÂtion of CerÂtain AcÂtions Act.
