THE State has been ordered to pay more than $100,000 in damages, interest and legal costs to a man who was wrongfully arrested over the disappearance of two welding plants from a construction site.
Justice Robin Mohammed ruled that the arrest of Gershon Seunarine, an equipment supervisor with construction company Kallco Co Ltd, was unlawful and that his subsequent detention amounted to false imprisonment.
In a judgment delivered on Friday, the judge found that the police officer who arrested Seunarine had no reasonable and probable cause to suspect him of stealing the equipment.
