THE State has been ordered to pay $115,000 in damages to a man whose constitutional rights were breached after police denied his attorneys access to him while he was being detained at the Cumuto Police Station.
High Court judge Robin Mohammed made the ruling on Friday in favour of David Junior Fernando Sanchez, who had filed a constitutional motion against the Office of the Attorney General after his July 2019 arrest.
In his judgment, Mohammed found that police unlawfully detained Sanchez and violated his constitutional rights by refusing to allow him to meet with attorneys Matthew Gayle and Jason Jones when they visited the station, as well as by failing to facilitate a telephone call.
