THE High Court has ordered that an employee of the Ministry of Works and Transport receive more than $220,000 in compensation from the State for breaches of her constitutional rights after she was unlawfully bypassed for promotion.
Even though Radha Ragoonath was suitably qualified to be promoted to the position of Auditing Assistant, the Public Service Commission (PSC) proceeded to promote five other people who ranked lower than her on a merit list that was generated after they wrote a civil service entrance exam in November 2011.
Justice Kevin Ramcharan on Wednesday ruled in favour of Ragoonath, directing that she be paid compensatory damages in the sum of $100,000 and vindicatory damages in the sum of $120,000.
