THE High Court has ordered that an employee of the Ministry of Works and Transport receive more than $220,000 in compensation from the State for breaches of her constitutional rights after she was unlawfully bypassed for pro­mo­tion.

Even though Radha Ragoonath was suitably qualified to be promo­ted to the position of Auditing Assistant, the Public Service Commission (PSC) proceeded to promote five other people who ranked lower than her on a merit list that was generated after they wrote a civil service entrance exam in November 2011.

Justice Kevin Ramcharan on Wednesday ruled in favour of Ragoonath, directing that she be paid compensatory damages in the sum of $100,000 and vindicatory dama­ges in the sum of $120,000.
