THE Appeal Court has ordered Laventille-based contractor Eastman Enterprise Ltd to pay the bulk of the CEPEP Company’s legal costs.
The order was made after the court ruled that the company had improperly bypassed an Alternative Dispute Resolution (ADR) mechanism when it turned to the courts earlier this year to challenge the termination of its CEPEP contract.
In a unanimous ruling delivered yesterday, Justices Peter Rajkumar, James Aboud and Ricky Rahim reinforced the requirement that CEPEP contractors ought to honour the ADR clause in their contracts before seeking relief in the courts.
