CHAIRMAN of the Equal Opportunity Tribunal (EOT) Donna Prowell-Raphael has failed in her bid to have the Appeal Court set aside the ruling of a High Court judge who found she had acted in bad faith by failing to have attorney Veera Bhajan take up her President-appointed position of lay-assessor with the tribunal.
In a unanimous decision delivered on Wednesday, Justices of Appeal Mira Dean-Armorer, Vasheist Kokaram and Malcolm Holdip, dismissed two appeals brought by Prowell-Raphael against the findings of Justice Avason Quinlan-Williams in November 2021.
The first appeal was procedural in nature and centred around the decision of the judge to not set aside her grant of leave to Bhajan to file judicial review proceedings against Prowell-Raphael and the EOT.
