FOLLOWING the State's failure to file the relevant application in relation to a deceased witness, two men charged with murder walked free yesterday.

In finding the men not guilty, Justice Sherene Murray-Bailey said that parties involved in criminal matters must not be permitted to selectively comply with judicial directives, adhering to some while defying others without reasonable explanation.

Attorney Kevin Ratiram, who represented Randy Flemming, now plans to sue the State for malicious prosecution.
