IN a legal battle that essentially turned on how one defines a potato, has been determined in favor of the Comptroller of Customs and Excise, regarding the tax classification of frozen potato wedges.
The judgment, which was delivered by the Appeal Court on January 19, overturns a previous High Court judgment and settles a dispute with Westco Foods Unlimited over whether a "wedge" is legally the same thing as a "French fry".
At the heart of the case was a substantial tax hike.
