Judge sides with Customs officers

JUSTICE Frank Seepersad has warned that Customs’ investigative powers must be exercised within the law and that allegations of corruption against public officers must be supported by evidence.
The judge made the observations in a 41-page judgment delivered yesterday in a judicial review claim brought by Ultimate Supplements Ltd and Che Howell Enterprises Ltd against the Comptroller of Customs and Excise.
The companies had challenged the Division’s handling of several shipments of health, fitness and nutritional products, claiming Customs unlawfully rejected their declared transaction values, imposed deposits before releasing goods and delayed clearance.
