ALMOST seven years after former chief magistrate Marcia Ayers-Caesar brought legal action against the Judicial and Legal Service Commission (JLSC) over her 'forced' resignation as a High Court judge in 2017, the Privy Council will on Monday rule on whether her appointment was in fact unlawfully terminated.
Should the British law lords rule in favour of Ayers-Caesar, it would mean that for all the time the matter has been before the court, she was still a justice of the High Court and, therefore, entitled to all of the salaries she would have received from the date of her appointment to the date of the final ruling.
In addition to that, Ayers-Caesar would also be entitled to compensation for breaches to her constitutional rights.
