IN a significant victory for the estate of a deceased landowner, the Court of Appeal has ruled that Digicel Trinidad and Tobago Ltd was liable for trespassing on a parcel of land in Freeport to erect one of its cell towers.
The judgment, delivered by Justice Nolan Bereaux on Tuesday, and supported by Justices Mark Mohammed and Geoffrey Henderson, overturned a prior High Court decision that had dismissed the claim against the telecommunications company.
The legal dispute centred on a “battle of the surveyors” to determine the rightful owner of the land.
