THE Appeal Court has upheld a High Court ruling granting leave for judicial review in a dispute over disciplinary measures imposed on a 12-year-old student of ASJA Girls’ College after she was caught cheating during an exam in 2024.
In a judgment delivered on Friday, Justices of Appeal Vashiest Kokaram and Eleanor Donaldson-Honeywell dismissed an appeal by the school’s Acting Principal, Aliyah Amarsingh-Mohammed, and the San Fernando ASJA Education Board of Management, affirming that the claim raises an arguable public law issue fit for judicial scrutiny.
The student, a Form One pupil at the time of the incident, was found with unauthorised notes during a Geography examination on June 14, 2024. A disciplinary conference was held on June 18, 2024, after which the school applied its examination policy.
