THE Appeal Court has overturned a previous High Court ruling and declared that the last Government’s failure to disclose the policy and criteria for granting re-entry exemptions during the 2020 Covid-19 border closure was a breach of citizens’ constitutional rights.
The court found that the lack of transparency infringed upon the fundamental rights to liberty and the protection of the law for two Trinidadian women who found themselves stranded abroad.
The judgment, delivered by Justices of Appeal Nolan Bereaux, Mark Mohammed, and Ronnie Boodoosingh, allowed the appeal brought by Raehanna Lorick and Joanne Pantin against the Office of the Attorney General. Justice Mohammed concurred with the separate written judgments of both Justice Bereaux and Justice Boodoosingh.
