THE mother of a child born with cerebral palsy has secured permission from the Privy Council to challenge aspects of a medical negligence case against a private clinic in San Fernando.
In a twist that adds further complexity to the case, Dr Marwan Abdulla, the obstetrician at the centre of the lawsuit, was also granted leave by the apex court to appeal the Court of Appeal’s ruling that found he had acted negligently, but that his negligence did not contribute to the boy’s health condition.
Shelly-Ann Balwah, acting on behalf of her son Aeden, had obtained permission from Lords Briggs, Burrows, and Stephens on November 1, to appeal the Court of Appeal’s decision, which had upheld the dismissal of her claim against The Surgi-Med Clinic.
