CONVICTED killer Daniel Agard has failed in his bid to be immediately released from prison after the High Court dismissed his challenge against the way prison authorities calculated the remainder of his sentence.
In a ruling delivered on Monday, Justice Westmin James held that Agard was not entitled to claim remission for the 22 years he spent behind bars before being resentenced in 2024.
Agard, who was resentenced to 28 years’ hard labour after the mandatory death penalty applicable to his conviction was set aside, had argued that remission should apply not only to the time remaining on his sentence, but also to every year he spent in custody since 2001. If accepted, that position would have meant that Agard’s sentence had effectively expired, entitling him to walk free immediately.
