HIGH Court judge Frank Seepersad has ruled that the Office of the Director of Public Prosecutions (DPP) cannot rely on administrative challenges or heavy workload to justify delays in deciding if to indict two police officers charged more than a decade ago.
In a judgment delivered yesterday, Justice Seepersad declared that the failure of DPP Roger Gaspard, SC, to determine whether to proceed against Sgt Lester Garcia and PC Dexter Edwards amounted to an unreasonable delay.
The judge ordered that the DPP must make a decision within 35 days on whether to file indictments or discontinue the proceedings.
