Trial in the 2020 elections fraud case was adjourned on Monday, after Defence Attorney Nigel Hughes objected to prosecution of witness Anneal Giddings, former Deputy Chief Elections Officer (CEO), who gave his testimony virtually.
It was later indicated that Giddings is currently out of the jurisdiction, with uncertainty surrounding when he is expected back. As such the case was adjourned for the day, with trial scheduled to resume today. It is not yet known which witness the prosecution has lined up for today. The only witness scheduled for the day, Giddings appeared via Zoom when the case resumed before Acting Chief Magistrate, Faith McGusty, on Monday however Hughes objected to Giddings being allowed to give his testimony virtually. The prosecution was called to answer for Giddings absence and a short adjournment was called for the prosecution to contact Giddings.
Following the resumption the prosecution indicated that Giddings could not be available at an immediately foreseeable date. Last week, Registrar of the Supreme Court, Sueann Lovell, testified during which all of the Statements of Recount (SoRs) for the Regional Elections were lodged. During her first appearances, Lovell would have verified and lodged all of the original Statements of Poll (SoPs) for the March 2, 2020 General and Regional Elections. There were a total of 2339 polling stations, resulting in 2339 SoPs and 2339 SoRs for the General and Regional Elections, respectively. Nine persons are charged with conspiracy to commit electoral fraud in relation to the tabulation of votes for Region Four in the 2020 General Elections. Those charged include former CEO Keith Lowenfield, former Deputy CEO Roxanne Myers, former Region Four Returning Officer, Clairmont Mingo, former A Partnership for National Unity + Alliance for Change (APNU+AFC) Minister Volda Lawrence, former APNU+AFC Chief Scrutineer, Carol Smith-Joseph, and former Guyana Elections Commission (GECOM) employees Enrique Livan, Sheffern February, Michelle Miller and Denise Bobb-Cummings.
